The U.S. legal industry has seen significant transition in recent years. The advent of the Le- ahy-Smith America Invents Act (AIA) created new post-grant proceedings that allow parties to challenge patents at the United States Patent and Trademark Office (USPTO), rather than in the traditional venue of federal courts. The statutory mandate to complete these proceedings within twelve months, offers a lower cost alternative to court litigation, and has shifted the venue of many patent battles to the USPTO. Our firm can more than accommodate for changes such as these, as Brinks Gilson & Lione’s Post-Grant Patent Practice group includes over 40 patent attorneys with experience both in the courtroom and at the USPTO. The Brinks team will work with clients to develop and implement a comprehensive and coordinated litigation plan designed for success in the courtroom, in the pat- ent and trademark office, and in the marketplace. And this will be done in a cost-effective manner designed to meet the client’s budget and exceed their expectations. Although inter partes reviews (IPRs) and covered business method patent reviews (CBMs) have only been available for a few years, BGL has jumped to the forefront of this new type of proceeding and has served as lead counsel in many cases before Patent Trial and Appeal Board (“PTAB”), including some of the first CBMs and some of the first appeals of post-grant PTAB proceedings to the Federal Circuit.
