In the last few years, Italy has refreshed its labour laws, following two main tracks: simplifying the laws and adopting new solutions which take into account a more valued point of view of the employer. As these laws have been revamped several important goals have been reached. On the first hand, the recent laws known as the ‘Jobs Act’ innovates matters regulated by laws dating back to the 70’s such as the Social Safety Nets; and has reduced dozens of laws to a smaller number. Many innova- tions have been introduced which match the business needs in the management of the labour relationships, even amending big issues that employers used to face. The new rules move from a double start line and pursue a greater efficiency and system-costs-reduction of the management of employment issues. For instance, in the case of judicial litigation for individual dismissals or collective redundancy, the risks arising from the length of the trial is not entirely supported by the employer but is capped to a predictable range, except in cases of discrimination and other serious faults which are avoidable with due professional support. Furthermore, the new rules for employment contracts have made them more risk-free. It is now possible to sign a fixed term contract without any mention of specific reasons which were necessary up to last year and originated thousands of law-suits. Also, it allowed the signing of the new ‘Increasing Protections Contract’ by which the severance pay is not the maximum from the first day of employment but starts after a monthly salary indemnity for new employees which increases over the years of service.
